1. About these terms
These Terms of Service ("Terms") govern your purchase of a session, event, service or by utilizing the services from No Wake Zones LLC ("No Wake Zones," "we," "us"). By purchasing a ticket or reserving a spot, you agree to the following Terms.
These Terms are separate from, and in addition to, the Participant Waiver you'll be asked to review and sign before checkout. You may not purchase a ticket or utilize our service unless you execute the Participant Waiver. The waiver addresses the potential risks which could result during participation; these Terms address the purchase itself and terms of use.
2. Reservations and ticket sales
Sessions have limited capacity. A reservation is confirmed only once payment is successfully processed. We reserve the right to limit ticket quantity per person per session.
Prices are listed in USD and are subject to change for future sessions; the price you pay at checkout is the price that applies to your reservation and that session only.
3. Cancellations and refunds
All sales are final. Tickets are non-refundable and non-transferable, including in cases of cancellation by you or failure to attend (no-show). By purchasing, you acknowledge and accept this policy.
Cancellations by us: If we cancel a session (for example, due to weather, venue issues, or insufficient signups or circumstances beyond our control), you will be offered a full refund or a credit for another session at your choice.
4. Health and eligibility
Participation involves entering a body of water for an extended, reclined period. By purchasing a ticket, you confirm that you are not aware of any medical condition that would make participation unsafe, or that you have consulted a physician and been cleared to participate. Full details are provided in the Participant Waiver, which you must acknowledge and the Participant Waiver must be signed before your purchase is completed.
Guests must be at least 13 years old. Guests ages 13 to 17 must be accompanied by a parent or legal guardian (age 18 or older) who is also participating, with a maximum of two guests ages 13 to 17 per participating adult. Guests under 13 may not attend. A parent or legal guardian must agree to these Terms and to the Participant Waiver on behalf of every guest ages 13 to 17.
5. Conduct
We want every session to be a calm, respectful experience for all participants. We reserve the right to remove any participant from a session, without refund, for behavior that is disruptive, unsafe, or disrespectful to facilitators or other participants. A guest under 18 who disrupts the experience may be asked to leave the pool area with their accompanying adult.
6. Photography and media
No Wake Zones LLC may photograph and/or film sessions and events. By participating, you consent to being photographed or filmed, and you agree that these images and recordings may be used by No Wake Zones LLC for marketing and promotional purposes, including on our website and social media, without additional notice or compensation.
7. Limitation of liability
To the fullest extent permitted by law, No Wake Zones LLC's liability in connection with any session or purchase is limited to the amount paid for that session. Nothing in these Terms limits liability that cannot be limited under Illinois law.
8. Changes to these terms
These Terms may be updated at any time. The version posted at the time of your purchase applies to that purchase and that purchase only.
9. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles and venue shall be the Circuit Court of Cook County.
